Hope XDJM gives your experience for my following problem:
1. I am F1 student and will graduate Spring 2006.
2. My hu*****and submitted NIW I-140 to NSC in May 2005 and plans to submit 485 before the end of this month because of the coming EB-2 retrogression.
3. We also applied for Canada green card and just finished medical exams last month, and I am principal applicant. Hopefully the approval notice will come recently (maybe between August to December, but who knows).
So the problem is:
If I submit 485 with my hu*****and, (a) I can NOT go landing for Canada PR because of 485 pending. I do not want to use AP that will lose my F1 status after coming back to the US; (b) I can NOT obtain my OPT because of 485 pending that shows clearly my intent to immigrate against F1 status. However, OPT may be important for me to find a job since I am graduating during next Spring.
If I do NOT submit 485 with my hu*****and, I do not know when I can submit my 485 due to the coming EB2 retrogression. If the retrogression takes years, that is too sad for me. I do not know what I should do this time, submit or not?
