What should my hu*****and's Eligibility Category be on form I-765, question #16? His application is based on received I-485, and his I-485 was filed with my NIW application. I considered him to be (c)(9) category-- EAD Applicants Who Have Filed for Adjustment of Status. In the original application I submitted, I put down (c)(9) for this question and left the third () empty. However, it seems like this is not the correct answer. My hu*****and's application was returned to us. The main reason was that I accidentally mailed out the form without his signature (what a stupid mistake!) The other reason they listed, is the eligibility category in question #16. where I put down (c)(9)( ).
Can anyone tell me what I should put into the third ( ), or is the category c9 correct in my hu*****and's case?
