I submitted my I-140/I-485 last Sep. Now I planned to go back to China next month due to something unexpected. So I needed to apply for AP in a timely manner. I asked ISSS in my school, my lawyer and some friends who had similar experience and decided that emergency AP is what I needed. Since I lived in a small city, I drove 3 hours today to Atlanta center to apply for emergency AP. Unfortunately, my request was refused as this office does not process emergency AP if AOS is employment based. Right after I came back, I consulted ISSS in my school and sent my I-131 package to TSC via fedex overnight. The address I sent to is for premium process, i.e. family emergency.
Although I failed my mission to get that in my local office, some of my friends did get that in other local offices. So it still worth a try.
Here is the checklist for my application. I combined materials from different checklists.
• Form I-131
• Fee: Money order in the amount of $170
• Copy of the hospital admission record of my grandmother, with English translation and notarization
• Two color photographs with Alien Registration Number (A#) on the back.
• Copy of the receipt notice of my I-485 application.
• Copy of I-140 approval notice
• Copy of current I-20 form
• A copy of Form I-94 (front and back)
• Copy of passport identity page and driver's license
Also I put a coverletter, stating that I met some emergency situation that I have to leave U.S.
ISSS in my school is very nice and helpful. She told me that in addition to sending my application to the premium process address, I also need to:
On the outside of the envelope put "Emergency I-131 - Expedite".
Attach to the documents on the inside a top brightly colored coversheet that reads:"Expedite Advanced Parole (I-131) document for family emergency".
And I did that.
Now I am still waiting for the result. But I did what I could do. The rest is not within my hand and I will take whatever it is.
If you need to go back to China in a emergent situation, you might want to try emergency AP. I still think that it least it worth a try. Some of my friends got that. My lawyer told me that a lot of his clinets got that in local office. You might have good luck in your local INS office, better than I had. We have been working so hard to apply for GC. I don't want to take any risk if that is not absolutely necessary.
