I currently have H1 status (not visa) and already submit I-485. I am filling I-131 to apply Advance Parole. Would you kindly let me know what Class of Admission is (Part 1. 3 of I-131 form)?
In addition, if possible, I would not like to use Advance Parole. I hope to apply H1 visa when I arrive in China, although I have AP. If I get the H1 visa approved, I will not use AP when I reenter US. Would you let me know if it is legal for me to apply H1 visa (regardless of approved or not), because I already applied AP?
My current H1 status will expire at the end of November 2006. If I reenter US with AP, can I still apply the extension of H1 status sponsored with the unchanged employer? It seems that I can do it based on the information from following website http://www.hooyou.com/h-1b/h1b_faq.html. However, I am not sure. Would you please give me your opinion? Your response would be great appreciated.
