有关 Nebraska Service Center的 Pre-Adjudication Initiative

By: Beth Robertie, Esq.

据Nebraska Service Center (NSC) 消息,为了减轻NSC中的I-485积压案件以及加速处理那些拥有Current priority date 的申请,NSC开始实行一个名为 Pre-adjudication initiative 的处理程序。以下请看有关消息:

As we have discussed many times on this site, the wait for a current visa number when you have an Application to Adjust Status (I-485) can be interminable. However, every once in while there is good news regarding the processing of I-485s. This may be one of those times. In an effort to reduce the backlog of I-485s and process them as quickly as possible once they have a current priority date, the Nebraska Service Center (NSC) has begun a pre-adjudication initiative. This means that even before a priority date is current, NSC will review some I-485s and issue Requests for Evidence (RFEs) if necessary, and fingerprint notices. Although NSC will not be issuing approvals if there is not a current priority date, the idea is to prepare the files for adjudication as much as possible, so that when the priority date is current the case can be adjudicated relatively quickly. Please note that although approvals will not be issued without a current priority date, denials will be issued if RFE responses are not received in a timely fashion or if the RFE response still does not establish the applicant’s eligibility to adjust. Should you receive an RFE or a fingerprint notice for an I-485 that does not yet have a current priority date, it is essential that you respond in a timely fashion and/or attend the fingerprint appointment as directed. Receipt of such a notice does not mean that an approval is coming soon – it merely means that as much is being done as possible in order to prepare the file for adjudication once the time comes.
