my case is EB3, PD 12/2003, regular process. now my case is in Texas
backlog center and I did not receive 45 day letter yet. Now our company
allow us to do perm refile. I want to refile my case using EB2. then I
definitely lose my PD since two cases are not identical. some friend here
suggest I should file another new case using PERM and keep old case at
the same time. but somehow, our company only allow us to refile, instead of file another one. then my quesiton is can I refile without requiring to preserve my PD? if I do so, is there any chance my old case will not be withdrawed? if refiling will result in withdrawing old case no matter if you
require to preserve PD or not, is it worth to do this refile without keeping
PD? thank you
