om May , I called the service cneter and talked with a representive, she told me that USCIS would respones to me in 30 days, then I called again after 30 days when I didn't received letters from USCIS, two weeks later, I received letters from USCIS and told me because of there is no Visa number available,so the process was bolged, they would put the case back to the process after visa number is available. but obviously the made mistake to take my case as EB3 (I am Eb2, NIW, PD Aug. 2004), my lawyer said the just copied another letter and change your case number, so it is not relaibble.
I then wrote a letter to my Senator, she inquired the USCIS why our cases (including my family) have not been update for 10 monthes and already over the USCIS's process date. then we recieved letters again from USCIS, this time, the letters are real our cases (not EB3, but Eb2), and told us there are no visa number available.
Does this mean that the name checks of our case have clear? if not they should tell us we are under name check.

Nothing to do with Name Check. They just simply told

the phone number is right

If they specifically told you NC is cleared, then yes.
