Your concer is the case happened to my wife recently. She went to back with AP and H1, but was checked-in when reapplying the visa. We consulted with layer and international office and was told my wife can come back with AP with the check-in is still in progress. But she chosed to wait since once she gets the valid H1 stamps, she can apply visa for our daughter (H4), and she can reapply H1 visa when she moves to another company. But you have to know you can just stay in the same institution once you used AP. I plan to go back china with AP next week, and will be back with AP.
