I always hear people talking about getting an H-1B visa in a third country. I have a couple of questions.
1. Is the visa application at a third country subject to background check? and will that mean you will have to stay in that thrid country (Mexico or Canada) that long to wait for it?
2. If the visa application is denied, will the applicant be able to come back to the U.S.? I know he/she can't use the I-94 to come back, once a visa is applied for.
3. I also heard from this forum that if the 485 is pending and if one wants to change to H-1B status from another non-immigrant status, e.g. J1 or F1, he needs to apply for a visa outside of the U.S., but if he/she don't apply for AP before going to get the visa abroad, will he be regarded to have given up the 485 application?
