EB3 to EB2 using same approved LC A78563202007-05-19 15:48:01

I have approved LC that meet EB2 requirement (Bachelor + 60m experience). However, My company's lawyer applied EB3 I-140 and it was approved. Since the LC's priority date is 10/2005, I have requested company to apply EB2 I-140 and carry over the priority date. The lawyer said EB3 I-140 has to be withdrawed first before EB2 I-140 can be applied base on the early approved LC.

1. Has anyone have same situation and how do you handle the EB3 to EB2?
2. Has EB3 I-140 to be withdrawed if EB2 I-140 application is based on the early appoved LC?
3. Are there any other solutions to change from EB3 to EB2 (Employment Based)
4. Can I concurrectly file EB2 I-140 and 485 since EB2 VB is 01/2006?
