Thanka a lot for your answers to my following two questions. However I do not quite understand why the h1 quoa is required in situation I, while the quota is not required in situatin II. Appreciate very much if you could explain this further.

The original questions:
Situation I: One used his first H1b for 2 years and then stopped in 2000, Is it possible to apply H1b now again without H1 quota?
Situation II: One used his H1b for 4.5 years (renewed once) and then stopped in 2004. Is it possible to apply H1b now again without H1 quota?
in both situations, the time period starting from the H1b first issuing date to now is over 6 years and both stopped over a few years.
