H-4 until 02/13/09.

My dependent have a new I-94 when coming back from China last summer. The port officer wrote on the I-94 " H-4, until 2/23/2009", but our I-797 shows the H-1B and H-4 valid until 2/13/2009. Which date should I use for the H-4 status expiration date in the I-485 form: 2/23/2009 or 2/13/2009?

I think 2/13/2009 should be used because my H-1B is valid until 2/13/2009. Am I right?
