I failed to find a new company to sponsor my H1B due to the H1B transfer fee higher than before, $2,570.00 without lawyer's charge in the last 3 monthes.
My case brief as follows:
EB3 with approved Labor Certificate, PD Oct. 2003 @TSC
form 140 submitted in Sep. 2007.
On May 28, 2008 the petitioner was sent a letter requesting additional evidence.
On June 12, 2008 the petitioner submitted a respones.
On July 31, 2008 Notice of decision sent to the petitioner the Form I-140 be denied for the following reasons:

The petitioner submits no additional evidence of ability to pay the proffered wage.
My Boss gave up to appeal within 33 days after he got the denial letter. He wants refile MY form I-140 now.
My questions are
1. Is my case eligible to reopen after 33 days limit?
2. which way is better for my case, ask reopen or refile form I-140?
