My wife now uses her OPT to work, but it will expire in a week, then she will be in H4. Based on my NIW application (140 and 485 together), she has already received EAD. Our attorney suggested my wife not use her EAD before the GC application result is clear. My wife's company agrees to file H1B application for her for the year 2006, and asks my wife to continue work with her EAD until October when H1B is available. The question is if she follows this way, how her status will be influenced. When she gets H1B after using EAD, is she no longer subject to the restrictions on AOS? Thanks for all answers.
