The lawyer of my company submitted my H1B application on August 11, 2005. It is only one day late but I was told that I wont get H1B for year 2006. Crying!!! My OPT will expire around the end of May next year and I only have Bachelor degree from U.S.--Finance major. My company is kind of big (900 employees) and the Human Resource lady felt very sorry about my case. Actually, it is the lawyer's fault to file my case late. I started to work for the company around the early July. HR told me that they are taking into this information and they have never had same situation before. They also told me that they will talk to me later next week.
I am not sure how the company is going to handle my case. If the company is willing to file 2007 H1B for me but there is still time gap between June to September 2006, which means I can't work during that time. What should I do? How should I negocaite with the company or lawyer? I am totally blank now. I do not know what I should say to HR or lawyer. Will I be fired from the company just because that studpid atterney's mistake. Your opinion is really appreciated. Also, should I transfer back to F-1 after my OPT expires. Million thanks!
