I am about filing I40. No plan to file 485 at the same time. Yesterday, my lawyer told me that there is 5 years retoregression, so it could be better for me to file two application at the same time. I am in H1B. The problem is my wife is still in F1. Will filing 485 affect her application for H1-B later (maybe the next year)? One version I heard is that the two things are not related;another version is that she need to apply for visa in a third contry.
Which one is correct? What should I do? Please help if you know. Many thanks.
