My status is H4, my hu*****and's is H1B. I am a registered nurse in NY and VA. A nursing home may sponsor me for green card by filing I-140 and I-485. We may face this situation that my hu*****and lose job after I file I-140 shortly. I will put my hu*****and and child in my I-140. Are we legally to stay in US in I-140 pending or I-485 pending without any other legal status because my hu*****and get laid off? With approved I-140, can our family stay legally in US if I-485 is rejected for unavailable document (VisaScreen) or can file I-485 later? Thanks a lot.
