My OPT will expire on Jan. 31, 2006, and my employer filed my H1b (start date is Jan. 16, 2006) in Premium process. I checked the web that said my case has been approved and the approval notice has been mailed out on Jan. 11, 2006. But we did not receive the notice until now. My employer called CIS, and they ask her to file a form I8XX (I am not sure which form) to ask for an reissue of the approval notice.
Before I receive the official notice, I can work under my OPT (even the new H1b starting date is Jan. 16, 2006)? Am I right?
My question is whether I am legal to continue to work for my employer after Jan. 31 before I received the reissued notice?
