Can I resume H1B with a few months gap in between? If I stay at home for a few months, the INS would assume I am taking advantage of the pending I-140 or I-485, thus I automatically give up H1B status and I might not be able to resume H1B status.
Also as mentioned yesterday, I have I-140 pending (NIW and EB-1A) and I-485 pending (with NIW). I have some concern, if I leave the US or staty at home for a few months, the NIW would become ineffective and, consequently, jeopardizes the I-485.

Sure, my current H1b expires concurrently with my job in March. I already have a new offer, but it will start in early July. That is the reason for the gap.
