I have some questions about I485
application of my hu*****and. He submitted his I-485 along with me last July. He
often returns to China and re-enters USA by H-4 visa. Right now, he is in the
United State and will leave for China soon. Next time that he expects to re-
enter USA is middle of July this year. He always has no enough time to wait for
approval of a advanced parole. So, he can only re-enter USA by H-4 visa.
However, my H-1B status will expire on the end of August. I am not sure whether
he still can apply for his H4 visa using my previous H1 status documents or he
can not apply for H4 visa until renew of my H1B is done. In addition, during
the periods that he leaves USA, if my 485 is approved (my priority date is June of 2004,EB1b), what will happen to him? Is my H-1B still valid? Can he still apply
for a H-4 visa to enter USA? I would appreciate your help. Thanks.
