Can I apply the AP right now? anderson2006-03-06 06:06:16

My I-140 was approved and I-485 is pending. I want to apply Advance Parole (I-131) for going back China September, but my H1-B visa will expire Augest.

So can I apply the AP right now? or I must apply the AP after renewing H1-B visa.

I would greatly appreciate if you can help me!
