Can I file I-485 now? ranranbaobei2006-04-07 20:01:21

I was not able to file concurrent I-140/I-485 after my EB2 based LC case was approved end of last year due to the visa retrogression occurs Oct 2005. Therefore I only proceeded with I-140. Since the cut-off date for EB2 of May06 is 01Jan 04, and my PD is Nov 2003 which is current, can I file I-485 now even though I-140 is pending? Do I need to wait until I-140 approved? Thanks.

You can file 485 with a copy of your 140 receipt next month
