I filed mine NIW last April. My wife’s PD is 2002. She filed the labor certificate and then I-140 and I-485.At the time she filed her I-485, we were not married yet. Her I-485 is still pending. I consulted my lawyer once and he told me that I can only apply for one I-485. If I want to use my wife’s Priority Date and file another I-485, I need to withdraw my NIW I-485, according to my lawyer.
But Xiaobaitu and other people informed me that I indeed can file two I-485s.
Could you guys please find the memo from USCIS for me? Or another link or website I can find the information? My lawyer insists that I can only file one I-485. I need to show him some evidence.
