I filed I140/I485 concurrently on Aug.2004 (EB2). My I140 has been approved last May but I485 is still pending. My wife needs her H1B1 renewed this July but her company doesn't want to pay the legal and service fee (about $2700). Another choice is that she changes to H-4 (I still hold the H1B1 visa at a Univeristy) and works with EAD card. The question is that I am looking for a job in industry and I may give up my H-1 (I need quota for H1B1 if I work in industry) status and work with my EAD. Is there any risk if we don't have legal status during the I-485 pending? Which is the better choice? I am thinking that I may get green card just after we pay $2700 for my wife's H1B1.
