History and current situation:
• I was a B-2 visitor from Taiwan to visit my mom, who is holding working visa, in US in the summer 1996 and I stay to now
• meanwhile, I applied for I-94 for staying longer to substitute B-2 visiting visa to F-1 student visa in late 1996.
• During applying to F-1 visa, I had been full-time student at school and received the denial letter from immigration in 2000 summer. I continued to go to school to finish my degree afterwards.
• I started the graduated school in 2000 December. In 2002 summer, school told me I couldn't register because of my status.
• I married my ex hu*****and (white) in Nov, 2003
• We filed I-130 and I-485. I also went back to school in Jan 2004
• Due to financial pressure and culture differences, he moved out in Sep 2005.
• Last week, he received I-130 is denied and he signed the petition for me to get ready to file out.
• We divorced yesterday because he has a girlfriend now; however, he still supports me to get the status.
Questions:
1. I don't care about the green card or citizen. Is there anyway I can stay here legally to continue my graduated school?
2. if go back to Taiwan to get F1 is the only way. will I have problem to get the visa? and how can I wave that 10 years Bar. (I heard there is a way to wave it?)
3. Should I file the I130 petition?
4. Am I qualified to 245i?
5. if I apply to Canada, will this help me to re-enter to USA?
6. as May 17, 2006. the new immigration my law, will this benifit me?
7. Any recommendations you can think of?
