我是去年12月交的EB2-NIW申请(加州中心),今年3月收到通知说申请被转到TSC,4月27号收到补件通知,要求7月10号之前交.
这是我交的材料:6封推荐信(4个教授(其中一个是院士),1个国家实验室,一个公司的(以前做过FUNDING AGENT), 16篇JOURNAL PAPER, 10篇会议论文,2个PENDING PATENT,做过REVIEWER,打印了所有的文章,包括30篇引用我的文章,实在想不同还有什么可以补的了.
关于补件,我的律师有如下建议,(我觉得有写问题,希望各位帮忙看看,是否我应该换律师
1.我的律师说让我找原来的4个推荐人,把推荐信重新写一下,添一些移民局想看的东西.我的问题是,大家补件的时候,都是找原来的推荐人重写一遍吗?还是最好重新找人了.
还有,这种补交的信是否该有什么特殊写法?谢谢
2.建议之二是,律师觉得现在TSC比较乱,因为有不少申请从别的中心转过去,很多文件对不上号,所以我的补件材料应该晚点寄.大概6月底子7月初的样子
3建议之三是,律师觉得我要补件的原因很可能是中心在转移申请的时候,把我的文件丢了,所以建议我在寄补件材料的时候,把原来的所有材料再寄一遍.
不知道大家在寄补件材料的时候是否都会把以前的材料再寄一遍,以防万一呢?

'The evidence appears to establish teh beneficiary's employment is national in scope and that the empolyment may be in the natioanl interest. However, it has not been established that the national interest would be adversely affected if the petitioner were to take tht time to obtain a labor certification. The benefit the alien's skills or background will provide to the United States must considerably outweigh the inhere interest in protecting U.S workers through the labor certification process. The alien must benefit the national interest to a 'substantially' greater degree that would an available U.S worker having the same minimum qualifications. Playing an important role in a given project is not qualifying for a national interest waiver if the same role could be filed by a competent U.S worker. The evidence cannot simply enumerate the alien's qualifications or the objective requirements for the work, since these can be articulated on a labor certification. At issue is whether the alien's contribution to the field are of such unsuual significance that the inherent danger in waiving the labor cerfitication requirement is justified'
