Facts:
- I have been working for a reputed company since Sept 2000.
- Filed my Labor in June 2002 from Sacremanto Region.
- Cleared my State in 2003
- Labor still pending with PBEC
- Just started on my 8th year H1B extension (i.e upto May 2007).
- Company closing down the Sacrmento office (my location) in a few months.
So now our HR (and our company lawyer) says that beacuse my Labor was filed specific to Sacramento region and because this office is closing my Labor Application becomes invalid and I have no other recourse except to leave the country. Even if the Labor clears before the location closes they still cannot file I-140 because I-140 is specifc to the job, person and location and since the location doesn't exist anymore, the rest of the process cannot not continue. I also cannot be relocated to another location even inside CA, because H1 extension is also dependent on my continuing labor from Sacramento.
So from their perspective its the end of the road for me and I have to go back to China soon after this location closes. Is that really case? Has someone ever gotten into a situation like this and can help me out with some kind of direction? I am at a really desperate stage right now and any help would be greatly appreciated.
