My H1-B will expire on Jan 2008. I wonder under what situation that I can extend the H1-B? Some people say you have to file L/C more than one year, some say as long as your PERM starts, that's fine. Can anyone give me an explicit definition? I am asking this because my current employer doesn't want to file eb-2 for me, only eb-3. But EB-3 takes too long time. I'm thinking about changing the job. Do I still have time? Please advise.

I haven't filed any L/C. My company plans to file EB-3
