I just received the RFE regading my I485 application yesterday. Instead of the employment cerification request, I got a RFE which I never expected. The USCIS request me to send some documents which proved that I made a legal entry to US.
Please allow me explain what happened. I made a business trip to Canada last year. I stayed there for 4 days before I returned to US. My boss gave me a ride back. We were stopped at the border by an officer after I showed him my passport and my h-1b approval notice. We were asked to come to the office and talk to another officer. The conversation was brief. The officer asked me the reason that I went to Canada, how many days I had stayed. I answered the question clearly and showed him the conference program. The officer also asked what it was relationship between me and boss. My boss answered that I was his employee. The officer then detached the I-94 from my H-1B approval notice (I-797A) and stapled with my old I-94 together. We were allowed to leave after that. I did not question him at that him because I do not custom's SOP for dealing this kind of situation. So I had no new I-94 and I do not even have a stamp on my passport showed that I made the entry on that day.
The only thing I can provide is a letter from my boss to explain what was the situation. because he was with me when we crossed the border. My question is whether that is enough. If not, whether there are anything else I can do. I feel so bad.
I just hope my case won't be denied because other people's ignorance.
