I am working here as a H-1B holder (expires on . 2007), also I applied for Green Card last year in EB-2 NIW category, the I-140 was approved, and I-485 is still pending, and recently I got a Advance Parole . The question is if I come back with Advance Parole instead of a H-1B visa, what my status will be? Will my H-1B status still valid? Is there any problem when I renew H-1B next year? I prefer to keep my H-1B status when I-485 is still pending.


Answer:

You actually enter the U.S. as a parolee, however, the CIS also allows you to continue your H-1B status and we will still be able to renew your H-1B next year.

Years ago, when people entered in parolee status, they no longer held H-1B status, but that has changed.
