My case is pending in FBI since September 2005, more than 1 year now. I am finghting isolatedly currently. I would like to advocate more people to fight together. Here is the information I collected, hope being useful to share with others.
The key is money. USCIS is a fee-funded agency. USCIS is almost entirely dependent on application fees to pay for operating expense. This Year, EAD alone projectedly will generate $350 million for USCIS based on FY 05 revenue. It is USCIS enjoys the delay by FBI. I'd phone FBI for explanation. A lady told me that FBI will do expeditious process if USCIS makes requests. And more, USCIS pays FBI for name check. It is a fee-for-service business relationship. IN ANY COUNTRY, ANY GOVERNMENT AGENCIES WILL HIDE SOMETHING WHENEVER THEY TALK NATIOANL SECURITY. TO PLAY SUPER PATRIOT IS THE CHEAPEST WAY TO FOOL ITS PEOPLE. If USCIS wants, it has 1001 reasons to ask FBI to expedite their clearance. So, USCIS is a prostitute with 105% purity, ---holds its customers as long as possible to extract last penny of your money from your pockets.
Two ways we could do:
1) SueUSCIS/FBI collectively. There is very high opportunity to be rejected by a district court. They will argue that massive plaintiffs from different background lack of consensus.
2) Boycott interim benefits from USCIS: Everyone could do this for your self and for our dignity. We need everybody’s effects. Do not apply for EADs and APs, renew your non-immigration visas as late as possible. Let USCIS shrink from 15,000 employees to 3000. They will be panic first. We will not do it silently, let every applicants, practitioners etc know the facts. Importantly,
IT IS USCIS DOES NOT WANT THE NAME CHECK GOES SO FAST. IT IS THEIR LIFE LINE. IT IS THEIR POCKET MONEY. WE NEED TO MAKE EVERY EFFECT TO LET AMMERICAN KNOWN THE FACTS. TALK TO YOUR MEDIA BOTH LOCAL AND NATIONAL IF YOU COULD, YOUR SENATORS, YOUR CONGRESSPERSONS, PRESENDENT OF YOUR UNIVERSITY, YOUR BOSSES, YOUR ATTONEYS, YOUR NEIGHBOURS, YOUR COLLEAGUES. IT IS NOT OUR FAULTS. SO DO NOT BE SHY TO SHOW YOUR ANGERS, YOUR FRUSTRATIONS. WE WILL WIN IF WE COULD MAKE IT A SCANDAL WITH NATIONAL-AWARENESS. WE HAVE TO PEEL OFF THE SUPER-PATRIOT MASK USCIS PUT ON AFTER LAST NATIONAL-WIDE SCANDAL---ISSUING VISAS TO DEAD TORRERISTS WHO HIT WTC--- FOR WHICH WE ARE PAYING THE BILL.
