各位大虾,最近有人在范律师的网站问,H-1是否可延第八年如果第七年底I-485还没FILED(也就是说LC还在等,这一点请注意).回答是"NO".我当时大吃一惊.我的理解一直在LC等了365天后从第6年延到第7年,如果第7年底LC还是在等,就可以一年一年地延,直到LC被否(批准就不说它啦).这也是我从各个律师网站看到的解释,包括范律师自己的网站:(注意最后一段)http://www.fan-law.com/getArticle.cfmarticleID=334&language=1
我昏倒醒过来后就去问范律师,回答很明确,如果H-1在第七年底如果I-485还没FILED就不能延至第8年(当然LC就是还没下来啦既然I-140和I-485可以在LC批准后一起递).我又昏过去一次.然后我去找BCIS的雅思备忘录(YATES MEMO)原文研究:http://www.ilw.com/lawyers/immigdaily/doj_news/2003,0818-I140.pdf

Section A "permit H-1B nonimmigrants to obtain an extension of H-1B status beyond the 6-year maximum period, when (1)365 days or more have passed since the filing of any application for labor certification, Form ETA 750,... or (2)365 days or more have passed since the filing of an EB immigrant petition." So (1) is for LC, (2) is for I-140
Section B "The BCIS is required to grant the extension of stay of such H-1B nonimmigrants in one-year increments,until a final decision is made:(1)to deny the application for labor certification,or if the lab certification is approved, to deny the EB immigration petition that was filed pursuant to the approved labor certification;"...
Section D "One-year extensions of the beneficiary's H-1B status may continue until one of the events outlined in section B of this memo occurs."
在SECTION B的(1)的前半句明显说明LC还在等,当然不可能FILE I-485啦.我从YATES MEMO的全文里也找不到说第七年底前必须FILE I-485才能继续往下延H-1第8年.基于上面的YATES MEMO原文和范律师网站里那篇文章(尤其最后一段),请各位大虾群策群力,发表自己的理解,或者告知从别处知道的确切信息,给我解惑,谢谢大虾们啦.也希望别的不清楚的小虾们能获益.
