I came to US on a h1b, and got a 3yr multiple h1b visa from Vancouver canada(i was living in canada). i changed my employer after a year and got a new h1b approval, but i didn't apply for a new visa, but keep using the original visa together with H1b approval to go in and out of the country. Now my visa is gonna expire soon, but my current h1b approval still has 1yr. In order for me to travel, i want to get the h1b extended now so i can take a 3yr h1b approval to the consulate to get a new 3yr visa.
My question is:
If my employer files h1b extension now, will USCIS reject the application because I-797 still has 1yr left.
