我的基本情况是：
2004年6月递交RIR EB3 LC 申请
2006年2月递交PERM EB2 LC 申请
2006年5月PERM EB2 LC 批准
2006年7月递交 EB2 I-140，8月批准
最近，我在2004年递交的 EB3 LC也被批准。我在考虑递交EB-3 I-140 然后再
把EB3 的Priority Date carry over 到EB-2的申请上来。
根据：
8 CFR § 204.5(e):
A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b)(1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b)(1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien.
我公司的律师认为：
1。因为我EB2的I-140比EB3早被批准。所以EB3 的Priority Date 不能被carry over 到EB-2的申请上来。
2。假如我递交 EB3 的I-140 申请。 Priority Date将会变为2006年2月，尽管EB3 的LC是2004年6月递交的。
因为：“A petition approved on behalf of an alien under sections 203(b)(1), (2), or (3) of the Act accords the alien the
priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b)(1),
(2), or (3) of the Act for which the alien may qualify.”
我的问题是：
1。我公司的律师是对的吗？
2。我怎样才能利用我EB-3的Priority Date。
