I filed I-140 and 485 in April, 2004 concurrently. I-140 was approved in May, 2005. I-485 has been pending since 4/21/04. I decided to go visit China last summer so I started applying for AP in December 2005, which was approved in March, 2006. But on the approval notice, there was an error. USCIS made a mistake typing my country of birth incorrectly so I returned the original approval document back to USCIS. They claimed that error was from my I-485 so I sent a copy of my birth certificate to ask USCIS to correct that error. In November 2006, they finally sent me the corrected AP and changed my country of birth to China on my I-485. So far my I-485 is still pending. I am planning to file a WOM. But I am not sure if USCIS would argue that my I-485 is pending since November 2006 because of that error, instead of 4/21/04. Unfortunately I did not make a copy of my original I-485 petition when I first filed that in April 2004 so I cannot prove it was their fault. What do you think?
I called USCIS many times in 2006. I was told that the FBI security check is not clear yet.
