This is a long story, pls read patiently
I have a very good friend she has two marriages, she had a daughter with her ex-hu*****and and she has been living with her dad in China since my friend divorced. My friend is a primary applicant of Green card of her 2nd marriage family members, she didn’t apply GC for her daughter of her 1st marriage in China, but as you know, there are blanks in Form I-485 where you need to put info. of your previous marriages, like your child’s and ex-hu*****and name, DOB, divorce date…
Because my friend didn’t apply GC for her daughter, and thought it is not a problem to put all the true info. of her first marriage in I-485, now her EB1(OR approved already) based I-485 needs an interview at local CSC, as you know nowadays it is very rare to get an interview for a EB-base 485 case, so my friend and her lawyer guess the info she put in the form of I-485 maybe the main reason, her lawyer who is going to accompany her for the upcoming interview let her prepare her original divorce certificate and her daughter’s original birth certificate, but the problems are
1. She didn’t bring anything related to her 1st marriage with her to US, and she couldn’t find her original divorce certificate, only has a copy kept by her brother in China.
2. My friend’ daughter has a last name same as her mom(that is my friend’s last name) on her birth certificate which my friend’s brother kept in China, but later on, when my friend divorced, her ex-hu*****and got the right of raising her daughter, so he changed her last name back as his, so my friend put her daughter’s current name in Form I-485. My friend has no contact with her ex-hu*****and at all since she divorced and only very recently got in touch with her daughter in China, so it is very difficult to get the original two certificates from her ex--hu*****and.
So my questions are
1. The immigration officer will ask my friend to show her original divorce and her daughter’s birth certificate? Copies of these two certificates are OK for the interview?
2. It is OK to tell and explain the truth about the inconsistence of her daughter’s name in Form I-485 and her birth certificate?
3. All the factors will affect my friend’s GC approval?
4. Do you have any questions for my friend?
