My situation is:
My NIW I-140 has been approved but I have not filed I-485 yet.
My current H-1 will expire on Sep, 2007. And I still have one year H1 left before I reach the 6 year H-1 limitation.
Right now, if I find a new job in a non-profit organization/university, what can I do?
1) Can I apply a new H-1 of 3years because my I-140 has been approved? If in this case, can I start work after I get receipt for my new H-1 petition?
2) Can I apply a new H-1 of about one and half years till my 6-year H-1 is used up (for example, from June 2007-Sep 2008)? Also, if in this case, can I start work after I get receipt for my new H-1 petition?
What is the difference between a new H-1 petition and H-1 transfer?
