我现在是H1B 7th year, Green Card EB3 filed Feb 2004, labor certificate still pending at backlog center. My current company will be sold to a new company. Regarding my status I asked my current company paralegal, she said below:
“It is my understanding that New Company will document your public access file to reflect the corporate ownership. This will verify that New Company will assume all responsibilities and obligations of your H-1B. This assumes that you will remain in the same job at the same location. As for your green card, I will be forwarding today your file to New Company. New Company is up to speed on our progress toward your green card. We will need to wait until the labor certification is approved before proceeding with the I-40 and I-485.”
Is she right???? Does my new company or I need to file a H1-B transfer petition before I can work to the new company???
Please help!!!! (officially we are going to move to the new company scheduled for March 10 at 12:00 a.m). So if a H1-B transfer petition need before I work at the new company, there are only 2 days left.
