petitions were received on April 2nd, which far exceeds the number of new
H-1B petitions that can be approved. According to the USCIS regulations, a
special lottery will be conducted to select 58,200 of those H-1B petitions
for approval. The H-1B visa petition filed for you will be included in the
lottery. This is the first time in history that this has occurred and it
is anticipated that it will take the USCIS several weeks to conduct the
lottery.
The pending H-1B lottery does not affect your current status. For F-1
students who have or are applying for Optional Practical Training, the
employment authorization granted remains valid. For others in the US, the
application for change of status remains pending until further notice. For
those outside the country, your entry to the US will not be delayed since
the H-1B visa is not scheduled to start until October 1st.
