Xiaobaitu, could you share your ideas on the following matters?
1)I presently hold a H-1B status, and my employment-based I-485 application remains pending due to the backlog in visa availability. It seems that after using AP I will be able to continue working for my same authorized H-1B employer. However, I wonder if I will be allowed for a H-1B transfer inside the US once I find a new job afterwards. Or do I have to leave the States to file a new H-1B through consular processing?
2)While my I-485 is pending, shall I use my AP, or apply for a H-1B visa at the US Consulate in order to reenter the States? I am concerned about the possible lengthy H-1B background check due to my research area. If the visa officer do request a background check during my H-1B visa interview, can I withdraw the application, and instead use AP. Will they stamp a rejection on my passport, or just return my application?
