This is a quite complicated case. I started OPT last Aug and changed to H1B last Oct. I was laid off last week (June 6th, last paycheck to June 15th). My spouse is in OPT now with H1B approved in April 2007. As you know, the approved H1B will be valid through Oct 1st, 2007 to ---. Both of us have EAD cards (My EAD expires on Aug 20, 2007). I just want to stay in the US for about 2 months. Then I will be back to China in early August. My questions are:
(1) Do I need to change my visa status immediately?
(2) Spouse is in OPT, then change to F2 ?
(3) Spouse's H1B already approved, change to H4 ?
(4) What forms should I fill out for visa status change, I-539 ?
