i was working in the university, and in last october my group was out of funding, and my job may not be kept. so i applied for h4 in case i can't find any job before i got lay-off. and i was looking for a new job at that time. the lucky thing was i found a job at the same university, and was told that i can use the exist h1 visa. the only thing need to be done is to withdraw my h4 petition, and my lawyer did that. but however, just this monday, i got the h4 approval letter from ins, which means they didn't notice my withdraw request at all. now my lawyer is appealing for me with ins. so i don't know what kind of visa status i am in now.
i have to keep my current job in the university, what should i do? am i in a leagelly working status right now, since the appeal is on the way? what my lawyer told me is he contacted ins people, and those clerk said they have to report my case to their supervisor, and will let my lawyer know the result as soon as possible. my understanding is, before the final decision is made by ins, my current status is still h1. am i right? kind of one-way logic, but i really need a job...
