I filed my wife and my I-485 2.5 years ago based on my LC and the applications are pending on my name checking. According to infopass officer, my wife's name check passed long time ago. Now my wife already has her LC and ted her I-140 (normal processing). We asked her company lawyer to file a new I-485 for my wife (from what I learned from this bbs, it's OK as long as it has the same A #) but her lawyer said she can't. I appreciate it if you can help answer
1. Is it explicitly allowed according to law? Can you send me the link to the law so that we can argue with lawyer?
2. If my wife's new I-485 is filed, can she get her green card soon since her name check already passed?
3. Can my wife's new I-485 be filed right away or we need to have her I-140 approved first?
4. Can my wife's new I-485 application include me? Although I guess it won't help since my name check is pending.
