终于又有名额了，本来我估计是8月以后，没想到早了一个月。看来，基本面分析还是
有用的。
这次的特点，名额可能是只有10000， 基本是各方面拼抢速度。。。
其中的两个要点
广告时间是需要的，以前一般是40天。现在也一样。由于很多医院一直 在登广告，所
以他们可以直接把这个广告时间报告上去，如果这些医院过去没有登广告，那么就要40

美国的工作签证和绿卡很难，积累了大批人，很多人都会在这个时间递材料，会不会和
4月工作签证情况一样不知道了。参考07年4月的工作签证情况，由于当时工作签证只不
过持续几天，然后就不接受申请了，所以大家递材料要在7月1日以前递上去，换而言之
，立刻递上去比较有把握。
详细情况和所需的文件
刚刚出来的排期显示，来自所有国家地区的职业移民都可以在2007年7月1日起向移
民局递送调整身份申请。这是个重大的利好消息！等待调整身份的职业移民可以在第一
时间内准备好材料，包括身体检查在内，向移民局递交申请。
2007年7月份的职业移民排期, 除第三优先Other Work 外，全面有名额，大家都可以在
于7月初提出I-485 申请。以下为国务院6月3日发布的6月份劳工移民排期表：
第一优先： 全世界(包括台湾，香港)有名额, 中国大陆”有名额
第二优先： 全世界(包括台湾，香港) 有名额 中国大陆 有名额
第三优先： 全世界(包括台湾，香港)有名额 中国大陆有名额

抢占绿卡名额，美国律师意见

Once the applicant has completed the Questionnaires, I will prepare her
forms (immigration forms like i-140)for signature. Once the forms are
returned to me along with the documents listed above (including photos and

根据美国国务院7月13日公布的移民排期表，职业移民绿卡名额第一、第二、第三类优
先将在2007年7月全面开放。此一巨变发生在全美移民律师协会（AILA）年会召开期间
，自然成为来自全美各地移民律师讨论的热门话题。
应邀到会的美国国务院官员对于此项出乎意料的变化，公开或私下做了一些解释，并透
露了一些可能的未来走向。笔者根据自己与会期间了解的消息，做出如下总结，以告关
心此事的读者。
一、绿卡名额全面开放的主要原因在于，去年职业移民的名额大约有一万多没有用完。
虽然移民名额由美国国务院控制，但是，国务院要根据移民局提供的绿卡申请数据来计
算排期进度。显然，移民局去年提供给国务院的移民申请数据并不准确，从而导致了国
务院过度保守地计算绿卡排期，以致一万多名额白白浪费掉。
二、国务院在7月份全面开放绿卡名额，以期避免去年浪费名额的情况再度发生。所以
，用国务院官员的话讲，此一开放是打开一扇“窗口”，让符合条件的申请人提交 I-
485申请。
三、国务院无法预测，绿卡名额全面开放的情况会持续几个月。但是，据国务院官员私
下透露，全面开放的情况“极有可能”会持续到8月，甚至“有可能”会持续到9月。9
月是美国2007年财政年度的最后一个月。一般估计，全面开放的情况不可能持续到下个
财政年度。
四、在职业绿卡名额全面开放的“窗口“关闭后，如国会不增加新名额，国务院估计将
会出现比以往更长的排期。
五、因为移民局会在7月收到大量的I-485申请，所以，移民局处理I-485申请的进度会
大为放慢。

目前，很多人都在讨论这个10000名额是否就是底线和40天广告问题，另外还有出绿卡赞助的机构问题，我的几点总结
10000名额可能就是底线，一年剩下10000，加上今年不过20000，而护士5万名额用了1年多，以及8个月没有名额，积累的光护士类别大约就有2-3万，其他职业不提了。。。最有希望的是7月1日申请递进的人。
40天广告期是移民规定，由于小机构一般没有这个费用去预先登广告，目前很多人都在找医院，但实际情况是只有大医院才可以有这个预先登广告的可能，小的医院和养老院的可能是不大的，换而言之，很多小的医院和医疗机构在这个特殊的短时间里没法帮助你完成这个40天广告期的要求。政策是，只有具有了40天广告期的医疗单位提出申请，你才能确实在目前提出绿卡申请。按去年的例子，小心，不要律师收了你的申请后，40天才确实向移民局递交绿卡申请。
出绿卡赞助的机构正好相反，纽约这里举例，大的医疗机构都不出绿卡赞助，只有小的医院和养老院才出，但是又不能够在40天中帮助你申请绿卡。他们很可能实际上是对你绿卡申请无能为力的。

The job posting should include special language like CGFNS, English, Visa
Screen requirements. Those job posts for American nurses will not be
accepted by the USCIS for greencard. The posting should be posted by a
poster close to hospital lobby where most American employees can see clearly
. The posting should be done 10 working days and 30 calendar days before you
can file your case. The post should be within the last 180 days but after
10(W)+30(C) days (which is tricky). Large hospitals which hires a lot of
international nurses should be very familiar with such requirements, but
smaller hospital hiring almost none international nurses will not know about
it. You have to know it yourself.
