Current status: I am currently holding H1 visa and my wife is holding H4 visa. My I-140 was ted, however, we have not received approval or RFE notice. We plan to 485 applications soon!
Questions:
1. Can H4 holder apply AP but not EAD together with 485 applications?
Will it affect our H1 &H4 status? In case of I-140 rejection, will we lose our legal status if my wife applied AP and used AP?
2. IS there any requirement for how long H4 visa holder should stay in USA after 485 applications? I’ve heard that H1 visa holder my have to stay in USA for more than 180 days each year. Otherwise, the 485 application may be denied. IS it true and will it be the same for H4 visa holder?
