Here I just want to share information from my attorney about file two 485 from spouse and adding each other as dependent.
My attorney is from: Morgan Lewis & Bockius LLP. He said USCIS will reject the other 485 if they find you already have one (even though you have same A number in the application). If you have good luck, you will still get interview for the first one. But anyway, you probably get delay. He said USCIS has informed this rule several years ago.
From this forum, I get many information say it is OK for filing two 485. Is it possible most of them are not like the Morgan Lewis, too conservative. Or USCIS does not execute this "rule" strictly, we just do it to get dual 485 coverage. I do not know. But actually, I still hear the same result from some attorney, they do not suggest to file two either.
