Situation: My company's immigrantion lawyer told me that my spouse has to be physically present in US in order for them to file I-485 for the spouse along with my own application; and they cannot file I-824 neither for the spouse before my I-485 gets approval if he's not in US.

I thank you in advance if you have any suggestions to my question here.


1. Is this true? Is there anyway to get around the physical presence part for filing I-485?

2. What if the spouse comes back to US for a short period time in order to be eligible for the I-485 filing, is there anyway to prevent INS from knowing his leaving US? I heard that airlines are sharing passenger departures with INS now.

What about driving across border to Canada or Mexico?

3. Can I (either myself or find a lawyer to) file I-824 in July for my spouse even I'm also filing I-485 in same month and won't get I-485 in near future? Is it simply wasting money?

I done some research in this forum and there's suggestion to file I-485/I-824 together in July. And INS won't process I-824 until the principle I-485 is approved. What is it stopping my company lawyer to do so? I can't understand.
