Would you please give me your answer to my question:
I can file I-485 based on NIW now. But my wife and boy returned to China and may stay in China for a long time. According to Following-to-Join benefits, I may file my own I-485. When it gets approved, I file I-824 for them and then they can apply for immigration visa in GuangZhou. It was said that if you were married or you had children before you bacame a lawful permanent resident, and your spouse and your children did not physically accompany with you to the United States, your spouse and chilren may be eligible for following-to-join benefits. My spouse and boy did not physically accompany with me here when I file I-485, but they were in US with me for a couple of years. Are they still eligible for following-to-join benefits?
