I'm checking my sources as well, but IV is saying that a deal will involve something similar to, but short of, allowing adjustments to be filed when no numbers are available. A few days ago I mentioned that interim benefits like employment authorization and advance parole might be possible, but that filing an adjustment without a visa number is barred by the Immigration and Nationality Act. I'm hoping that the solution is something of that nature and that Congress will solve the problem by fixing 245(a)(3) and allow for adjustments to be filed without visa number availability.
