I am an Canadian TN holder. I have filed 140 (NIW) back on March 2007 and it is still pending. I like to apply 485 since it is current again. Questions: 1, I am afriad that it would raise "dual intent" flag if my 140 gets denial after my 485 filing, so I like to apply H1B to avoid that risk. could I apply 485 and H1B at the same time or I have to apply 485 after my H1B approval? because I don't have much time for waiting H1B approval. let's say, if my 140 gets denial after two months and my H1B gets approval by then, would I be in legal status since H1B holder is allow to have dual intent? 2. could I appy 485 myself first, my hu*****and does it later? (after my 140 approval?) he is TN holder too. is there any disadvantage to doing that? Thank you very much for any comments. Your help would be sincerely appreciated.
